Terms & Conditions

§ 1 GENERAL PROVISIONS

1. The subject of these Terms and Conditions are the terms of participation in the training for forklift operators, hereinafter referred to as the “training”.
2. The purpose of the training is education in the field of and acquisition of a licence for operation of forklifts.
3. The Participant of the training who undergoes the full training and achieves positive marks in the theoretical and practical exam shall be granted a licence to operate the forklift, confirmed with a certificate.

§ 2 TRAINING ORGANISER

1. The training is organised by Kursy Na Wozki Widlowe w UK, hereinafter referred to as the “Organiser”.
2. The Organiser undertakes to hold the training on operation of the forklift according to the offer selected by the Participant of the training.
3. The Organiser of the training shall provide the training materials, including the summary of the theoretical knowledge and all equipment necessary for running the practical stage of the training.
4. The Organiser shall make the training materials available on the website at www.cv-trainingltd.com and the Facebook profile of the Company. The Participant can download the materials at any time.
5. The Organiser shall not accept any liability for destruction or loss of belongings of the Participants during the training.

§ 3 TRAINING PARTICIPANT

1. The training can be attended by a person who:
a) has attained 18 years of age;
b) uses the English language at least at a communicative level;
c) has paid the fee for participation in the training in the amount and on the dates specified by the Organiser.
2. By registering for the training, the Participant concludes a contract with the Organiser where the former declares that they accept these Terms and Conditions.
3. Registration for the training is conditional upon payment of an advance in the amount determined by the Organiser.
4. The Participants are enrolled in the training on a first come, first served basis, subject to fulfilment of the formal requirements, including payment of the advance.
5. The Participant of the training shall wear protective footwear and a protective vest and have an identity proving document.
6. In the case of an epidemiological threat, the Participants shall wear protective masks and gloves in the place of the training.
7. During the training, the Participants must not:
a) consume alcohol,
b) smoke tobacco or use any other drugs,
c) revert to verbal or physical abuse or use vulgar vocabulary,
d) behave in a discriminatory manner,
e) create situations of threat to the health or life of the other Participants of the training,
f) hinder the running of the training,
g) behave in a manner commonly regarded as bad-mannered.
8. If the Participant breaches the provisions of Clause 3(7) above, the Participant cannot continue the training and the Organiser shall keep the payments made by the Participant in full.

§ 4 COURSE OF TRAINING

1. The training consists of the theoretical and practical part. The Participant must take part in both parts of the training.
2. The Participant shall appear at each part of the training on time, in the place specified by the Organiser.
3. Participation in the practical part is conditional upon the Participant’s reading the theoretical materials first.
4. The practical part of the training shall be held in the place specified by the Organiser.
5. The date of the training shall be set by the Organiser.
6. The Organiser reserves the right to change the date of the training for reasons beyond their control, for instance illness of an instructor, failure of a forklift, insufficient number of the Participants enrolled in the training or other circumstances bearing features of force majeure.
7. If the training is cancelled for reasons specified in the Clause above, the Organiser shall suggest a new date for the training, immediately upon subsistence of the above circumstances.

§ 5 EXAMS

1. Each stage of the course ends with an exam.
2. In order to obtain the licence of the forklift operator, the Participant must obtain a positive mark in the theoretical and practical part.
3. The exam in the theoretical part is held in writing (test).
4. The first take of the theoretical and practical exam is free of charge.
5. If a negative mark is obtained, retake of the theoretical or practical exam requires payment of the additional fee of ₤50.00, subject to prior arrangements with the Participant.

§ 6 TRAINING FEES

1. Participation in the training shall be paid, in accordance with the offer presented by the Organiser.
2. The fee for the training shall be collected on the first day of the training, except for the advance paid upon registration.
3. The Participant can pay the fee by:
a) payment in the place of training with a debit or credit card,
b) payment in the place of training in cash,
c) payment with a wire transfer.
4. The fee for the training shall be decreased by the previously paid amount of the advance.
5. The advance shall not be returned if the Participant resigns from participation in the training unless the Participant submits a declaration of resignation at least 48 hours before the commencement of the training.
6. If the Participant does not appear at the training for any reason despite reservation of a place, the paid fees, including the advance and the fee for the training, shall not be returned unless the Participant informs the Organiser of intended absence at least 48 hours before the commencement of the training.
7. If the Participant does not appear for any reason on the following days of the training, the training shall be discontinued and the paid fees shall not be refunded.
8. Resumption of the interrupted training by the Participant shall require repayment of the entire fee for the training and the advance.
9. If the Participant destroys the property of the school or others during the training, they shall incur the costs of repair or pay compensation in another form upon agreement with the Organiser.

§ 7 FINAL PROVISIONS

1. These Terms and Conditions form an integral part of the registration for participation in the training and are binding for all of the Participants.
2. The Terms and Conditions enter into force as of 16.11.2021.
